The Question:

Alex, a California resident, visits a large shopping plaza that is open to the general public and privately owned by a local real estate group. While walking in the outdoor common area, Alex steps on a loose brick in the walkway, causing him to lose balance and fall down a short flight of steps. As a result, he suffers a broken wrist and a mild head injury. Further investigation reveals that this loose brick had been reported several times by other patrons, but the property owner had yet to make repairs. Alex is considering a negligence lawsuit against the property owner for failing to maintain the walkway in a reasonably safe condition. Your task is to identify and discuss the elements that Alex must prove to establish the property owner's liability for his injuries.

Instructions for Response:

Please structure your response using the IRAC format: • Issue: Identify the primary legal issue.

Rule:

State the relevant legal rule(s), including any relevant statutory or case law authority.

Application:

Apply the rules to the facts provided, analyzing each element individually.

Conclusion:

Conclude based on your analysis of the application. You must cite a real California case that is relevant to liability on private property for a failure to maintain safe conditions. We recommend using Google Scholar to locate California case law: https://scholar.google.com/.

Additional Elements for Analysis:

1. Identify a defense the property owner might raise regarding foreseeability or the reasonableness of maintenance efforts, and explain how you would respond to this defense.

2. Discuss whether Alex’s injuries may be considered “reasonably foreseeable” under the circumstances, using at least one cited California case to support your position.
